General Terms and Conditions of Sale

Clause N°1 : Object

The general conditions of sale described hereafter detail the rights and obligations of the company Legend Age - France and its customer within the framework of the sale of the following goods: lip balm, make-up remover wipes, spray, moisturizing masks.
Any service performed by the company Legend Age - France implies the buyer's unconditional adherence to the present general conditions of sale.

Clause N°2 : Prices

The prices of the goods sold are those in force on the day the order is taken. They are denominated in euros and "All Tax Included" (VAT included).
Legend Age - France reserves the right to modify its prices at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.
The prices are applicable within the framework of the remote sale.

Clause N°3: Payment terms

Payment for orders is made :

• either by cheque
• or by bank transfer
• or by credit card via PayPal

Orders are payable in euros, including VAT and compulsory contributions and delivery charges. The Buyer shall be responsible for any bank charges (including in the case of a refund).
In case of non-payment or partial payment of any sum that would be due by the Buyer, in case of payment incident, or in case of fraud or attempt of fraud related to the use of the Site, including on the occasion of previous orders; Legend Age - France reserves the right to suspend or cancel any execution of an order and/or delivery, whatever its nature and level of execution.

Clause N°4: Right of withdrawal

In accordance with article L221-18 et seq. of the French Consumer Code, the Buyer may exercise his right of withdrawal without giving any reason as from the receipt of his order or the availability of the latter.
The period of the right of withdrawal is 14 days from the date of receipt of the order or the availability of the order.
The Buyer may only exercise his right of withdrawal from the date of receipt of his order.
In accordance with article L221-28 of the French Consumer Code, the Buyer may not exercise his right of withdrawal for certain products and in particular for :

• Goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection (e.g. lipsticks);

The Buyer may be held liable in the event of depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and, where applicable, the proper functioning of the products.
The product(s) for which the Buyer wishes to exercise his/her right of withdrawal must be returned in a condition suitable for resale (products in perfect condition, in their original packaging, unused or damaged, accompanied by accessories, samples, instructions, etc.).
If the Buyer has benefited from an offer on the Site against purchase, entitling him/her, subject to conditions, to one or more products offered in return for his/her Order and, due to the exercise of his/her right of withdrawal, he/she is no longer eligible for the offer in question; the Buyer shall then send the product(s) he/she wishes to return together with the offered product(s) received in return for the Order of the product(s) returned.
Subject to compliance with the present conditions in terms of time, condition of the products and terms of return of the products, the Buyer shall obtain a refund of the returned products. In accordance with the article L221-24 of the consumer code. Legend Age - France commits itself to reimburse the Buyer according to the payment method used for the initial transaction or any other means after agreement from the Buyer as soon as the products are recovered.
It is reminded that the costs of return of the product(s) and the risks inherent to the return of the products are at the expense of the Buyer.

Clause N°5: Clause of property reserve

Legend Age - France retains ownership of the goods sold until full payment of the price, in principal and in accessories. In this respect, if the buyer is subject to a receivership or liquidation, Legend Age - France reserves the right to claim, within the framework of the receivership, the goods sold and remaining unpaid.

Clause N°6 : Delivery

Delivery is made :

• either by handing over the goods directly to the buyer
• or by sending a notice of availability in the shop to the buyer's attention
• or at the place indicated by the buyer on the order form

The delivery period is five working days.
The delivery time indicated is given as an indication only and is not guaranteed in any way.
Consequently, any reasonable delay in the delivery of the products shall not give rise to the benefit of the buyer to :

• The allocation of damages and interest
• The cancellation of the order

In the event of missing or damaged goods during transport, the purchaser must formulate all necessary reservations on the delivery note upon receipt of the said goods. These reservations must also be confirmed in writing within five days of delivery, by registered post.

Clause N°7: Force Majeur

The responsibility of the company Legend Age - France cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in the present general conditions of sale results from a case of force majeure. In this respect, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

Clause N°8: Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law. In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Bordeaux.
